Can Americans Buy Property in Thailand? The 2026 Guide for US Citizens

Short answer: yes — a US citizen can legally own a condominium in Thailand in full freehold, registered in their own name. No residency, no visa category, no Thai partner required. What Americans cannot do is own land — and no, the US–Thai Treaty of Amity does not change that, despite what some sales pages claim. This guide covers exactly what US citizens can buy, the traps specific to American buyers, and what the numbers look like in Phuket, Thailand's leading resort market.

Americans are not a niche here: the United States is the number one source of foreign property enquiries in Phuket — 4,654 enquiries out of 54,628 tracked between December 2025 and May 2026, ahead of the UK (4,362) and Russia (3,210) (FazWaz via Thaiger).

What a US Citizen Can and Cannot Own

Condominium — full freehold, in your own name

Under the Thailand Condominium Act, any foreign individual — including Americans — can hold the title to a condominium unit outright. The single restriction: foreigners collectively may own no more than 49% of the residential floor area of a building (the "foreign quota"). While a building's quota is open, the purchase is straightforward and the Land Department registers the title in your name. The full mechanics are in our guide How to Buy Property in Phuket as a Foreigner.

Land and villas — leasehold or a Thai company

The Thai Land Code bars foreign individuals from owning land. Villas are therefore held via registered long-term leasehold or through a Thai legal entity; both structures need professional legal review before any deposit. The trade-offs are covered in Leasehold vs Freehold in Thailand.

The Treaty of Amity myth

US buyers regularly hear that the 1966 US–Thai Treaty of Amity gives Americans special property rights. It does not. The treaty allows US citizens and US-majority companies to operate businesses in Thailand with majority American ownership in many sectors — but it explicitly excludes land ownership. An Amity company does not entitle you to hold land the way a Thai national can. Treat any structure marketed as "Amity freehold land for Americans" as a red flag requiring independent legal advice.

What US Buyers Should Know About Money

Transferring funds from the US

To register condo freehold in a foreigner's name, the purchase funds must arrive in Thailand from abroad, in foreign currency, with the correct payment purpose stated. The receiving Thai bank issues the confirmation document (foreign exchange transaction form) that the Land Department requires at transfer. Plan the wire route with your bank and lawyer before signing anything — this is a formal registration requirement, not a technicality.

US tax obligations don't stay home

Thailand does not tax you for being American, but the IRS follows you. Owning Thai property may intersect with US reporting duties — foreign bank accounts used for the purchase and rental income are the usual touchpoints (FBAR/FATCA reporting for accounts, worldwide income reporting for rent). The specifics depend on your situation; budget for a consultation with a US tax adviser who handles expat clients. We flag this because it is the single most common blind spot we see with American buyers.

Thai-side costs

Transfer fees and taxes apply on the Thai side at registration, and condo owners pay ongoing building fees (management fee plus a one-time sinking fund). These are project-specific — request the exact schedule per property before committing.

What the Phuket Market Looks Like in 2026

Figures below are from C9 Hotelworks (May 2025), Colliers Thailand (2025) and REIC (via Nation Thailand):

  • Market-wide median condo price: THB 144,000 per sqm; newly launched condos in 2025 averaged THB 149,070 per sqm.
  • Median one-bedroom unit (30–40 sqm) by area: Cherngtalay/Bang Tao — THB 5.6M (~USD equivalent depends on the day's rate — we quote THB and convert at your bank's actual rate); Karon — THB 4.8M; Rawai — THB 3.8M; Wichit — THB 3.0M.
  • Average condo transfer value to a foreign buyer nationwide: THB 4.1M (REIC, 2025).
  • Median stated budget across 15,586 real Phuket purchase enquiries: THB 7.5M (FazWaz).
  • Oversupply is real: 40,600 units for sale across 343 projects (C9), with project take-up ranging from 12.5% to 100% (Colliers). Choosing the developer matters more than choosing the brochure.

Buying as an Investment: the Rules Americans Miss

Rental demand is deep — 71% of all Phuket property enquiries are rental enquiries, with a median asking rent of THB 35,000/month and long-term one-bedroom rents from THB 22,541/month (FazWaz). But two rules catch overseas investors:

  1. Daily rentals are restricted. Since late 2023 Thailand has intensified enforcement against nightly condo rentals without a hotel licence (C9 Hotelworks). The legal models: leases of one month or longer, or a project holding a licence. Run your numbers on the legal model — see Phuket Rental Income and Yields.
  2. New-build carries a resale gap. Non-branded new launches average THB 139,000 per sqm against THB 100,000 on the resale market — a 39% premium (C9). Off-plan buys you payment plans and modern product, but at exit you compete with cheaper secondary stock.

Do You Need to Be in Thailand to Buy?

No. Reservation, due diligence, contracts and payments are routinely handled remotely, with a power of attorney covering specific registration steps. Many of our transactions complete with the buyer visiting once — or not at all until handover. We still recommend viewing in person before committing if you can.

How Etagi Phuket Helps

Etagi Phuket is a real estate agency with offices on the island, working with both new launches and resale. For US buyers we verify the building's foreign quota and legal structure, source comparable transaction prices (not listing prices), coordinate the inbound wire documentation required for freehold registration, and support the deal through handover and rental. Free consultation — Zoom or WhatsApp, whichever works for you.

FAQ

Can Americans buy property in Thailand?

Yes. A US citizen can own a condominium unit in full freehold, registered in their own name, provided the building's 49% foreign quota (Thailand Condominium Act) is not filled. Land cannot be owned by foreign individuals; villas are held via leasehold or a Thai company structure.

Can US citizens buy property in Thailand under the Treaty of Amity?

The Treaty of Amity covers business ownership, not land: it lets Americans hold majority stakes in Thai companies in many sectors but explicitly excludes land ownership. Structures marketed as "Amity land freehold" deserve independent legal scrutiny.

Is it worth buying property in Phuket?

It depends on the project, not the island. Average condo take-up is 64.9% with a spread of 12.5%–100% across projects (Colliers 2025), and new-builds carry a 39% premium over resale (C9). With a verified developer, a legal rental model and a realistic budget (the demand core sits around THB 4–8M), the market is workable; bought on a render, it is not.

How much does a Phuket condo cost in US dollar terms?

Prices are set in Thai baht: the market median is THB 144,000 per sqm, and median one-bedroom units run THB 3.0–5.6M by district (C9 Hotelworks). Dollar equivalents shift with the exchange rate — convert at your bank's actual rate on the day, and build in a buffer for staged off-plan payments.

Can a non-citizen buy a house in Thailand?

A house (villa) — yes, but not the land under it in freehold: foreign buyers hold villas via registered long-term leasehold or a Thai legal entity. A condominium is the only property type a foreign individual can own outright.
